The central government said that 730 metric tonnes of oxygen has been supplied to Delhi as per the direction of the court, but Delhi does not need that much oxygen. The Center demanded an oxygen audit, but the court made it clear that at present, the supply of 700 metric tonnes of oxygen to Delhi should continue. However, the court also asked to consider the supply and availability of oxygen in the perspective of the entire country. There are clear indications, however, that a new discussion about oxygen supply and needs will arise.

Solicitor General Tushar Mehta, appearing for the Central Government, also told the court that on May 4, a survey conducted in 56 major hospitals revealed that they had sufficient stocks of oxygen. It was also noted that 730 MT of oxygen supplied has not yet been delivered. That is, the oxygen tankers are not empty yet. As such, future supply may be affected. Mehta said that Delhi is over 700 metric tons of oxygen, giving additional oxygen to it will reduce the supply of oxygen in other states where the infection is spreading. The court asked the officer present at the hearing to have the ability to supply and store oxygen. On which the official said that 56 hospitals have 478 MT storage capacity. The bench said that they want to know the storage which is still vacant. Mehta said that this is an ongoing process. 478 MT is neither always full nor empty. The bench asked if there was a buffer stock of oxygen. When Justice DY Chandrachud spoke about the death of a very senior doctor due to lack of oxygen, the Center said that there is either a shortage of oxygen supply from the Center or lack of distribution from the state. In such a situation, there should be an audit of oxygen.

It is not right for the Center to accuse Delhi. However, Mehra thanked for the supply of 730 MT of oxygen. Mehta, while opposing Rahul Mehra's comparison with other states, said that they are trying to make the case state versus state. It is not right for Delhi to talk about itself. The bench said after a lengthy hearing that it would issue a written order later.
